Welcome to ECHON Entertainment.

These Terms of Service (“Terms”) govern access to and use of websites and digital experiences operated by ECONG LLC, which owns and manages the ECHON Entertainment brand (“ECHON,” “Company,” “we,” “us,” or “our”).

These Terms apply to www.echonentertainment.com, live.echonentertainment.com, and ECHON-managed online features, including the ECHON Live event song-request experience.

By accessing or using these services, you agree to these Terms, subject to any rights or protections that cannot be waived under applicable law.

1. Purpose of Our Services

ECHON Entertainment provides information about professional entertainment, DJ services, event production, and related experiences.

ECHON Live is a digital event engagement platform that may permit authorized event organizers, staff, and guests to submit, review, and manage music requests and related event information.

Availability and functionality may vary by event, platform configuration, and user permissions.

2. Website Information and Inquiries

Descriptions, packages, photographs, service information, and other website materials are provided for general informational purposes.

Submitting an inquiry, scheduling a consultation, or requesting a quote does not guarantee availability or establish an entertainment services agreement.

Actual services, pricing, payment requirements, cancellations, rescheduling, and performance obligations are governed by the specific proposal, contract, or written agreement accepted by the client and ECONG LLC.

In the event of a conflict regarding contracted entertainment services, the applicable signed agreement controls.

3. ECHON Live Song Requests

ECHON Live permits event participants to submit music suggestions for events where the feature is enabled.

Submitting a song request does not guarantee that the requested selection will be played.

ECHON and its authorized entertainment personnel retain professional discretion concerning song selection, sequencing, timing, suitability, event restrictions, and performance decisions.

Requests may be declined, edited for administrative purposes, or excluded when inconsistent with client preferences, event guidelines, licensing considerations, or the overall event experience.

ECHON may limit the number, frequency, or availability of requests to maintain the integrity of an event.

4. Event Access and QR Codes

Certain ECHON Live features may be accessed through event-specific links or QR codes.

Users must not knowingly access events for which they are not authorized participants or attempt to bypass authentication, event boundaries, or administrative permissions.

An event-specific QR code or link should not be assumed confidential merely because it is distributed at an event.

ECHON may restrict, deactivate, or revoke event access when reasonably necessary to protect participants, prevent misuse, or administer the service.

5. Acceptable Use

Users agree not to:

Submit abusive, threatening, discriminatory, harassing, unlawful, or deliberately disruptive content.
Impersonate another individual or misrepresent their identity.
Submit unauthorized personal information belonging to other individuals.
Attempt to manipulate song-request counts through automated or fraudulent activity.
Interfere with website operation, security, or event-management systems.
Access unauthorized databases, dashboards, event records, or accounts.
Use bots, scraping systems, or malicious software to extract information or overload the service.
Upload or submit materials that infringe the rights of others.

ECHON may remove submissions, limit access, or suspend functionality in response to violations.

6. Guest Submissions and Content

Users may submit song titles, artists, comments, preferences, and other event-related information where supported.

You are responsible for the information you choose to submit and for ensuring you have the right to provide any uploaded content.

By submitting event-related content, you grant ECHON a limited, nonexclusive right to process, store, display to authorized event personnel, and otherwise use that content as reasonably necessary to operate the applicable service and deliver the event.

This permission does not transfer ownership of your original content to ECHON.

ECHON will not treat guest song submissions as permission to enroll participants in marketing communications.

Additional consent or authorization may be required for public promotional use of identifiable photographs, recordings, or other protected materials.

7. Children and School Events

ECHON may provide entertainment services for schools, youth organizations, and family events.

Event organizers are responsible for coordinating appropriate participation arrangements for their events.

Children under 13 should not provide identifying information directly through ECHON Live unless an appropriate process has been established for obtaining legally required authorization and implementing relevant safeguards.

Where appropriate, ECHON may disable certain features, restrict submissions, or implement alternative request procedures for youth events.

The designation of an event as school-safe does not independently establish compliance with children’s privacy laws.

8. Accounts and Administrative Access

Certain ECHON Live features may require authenticated accounts or authorization.

Authorized users are responsible for maintaining the confidentiality of their credentials and for activities conducted through their accounts, subject to applicable law.

Account holders must not share administrative access with unauthorized individuals.

ECHON may modify or revoke administrative access as reasonably necessary for security, event management, or compliance purposes.

9. Intellectual Property

ECHON Entertainment’s names, trademarks, logos, graphics, website content, software, interface elements, and original promotional materials are protected by applicable intellectual property laws.

No ownership interest or general license to use ECHON intellectual property is granted by accessing the websites.

Users may not reproduce, distribute, commercially exploit, or create unauthorized derivative works from protected ECHON materials without appropriate permission.

Third-party music, artwork, photographs, and trademarks remain the property of their respective rights holders.

10. Third-Party Services

Our websites and event workflows may integrate with or link to third-party services for booking, planning, payments, communications, hosting, analytics, or other functions.

Third-party platforms operate under their own terms, privacy policies, and technical conditions.

ECHON does not control every aspect of independently operated third-party services.

Access to some features may depend on the availability of those services.

11. Availability and Technical Interruptions

ECHON works to maintain functional and reliable online experiences.

However, website and ECHON Live availability may be affected by internet connectivity, hosting issues, maintenance, third-party interruptions, device compatibility, or other technical circumstances.

We do not guarantee uninterrupted or error-free operation.

ECHON may modify, temporarily suspend, or discontinue features when necessary for operational, security, or business purposes.

For booked entertainment services, any applicable obligations arising from service interruption remain subject to the signed entertainment agreement and applicable law.

12. Disclaimers

The websites and digital platforms are provided on an “as available” basis, to the extent permitted by applicable law.

ECHON does not warrant that every feature will always be uninterrupted, fully secure, or compatible with every device or network configuration.

Nothing in these Terms excludes warranties, responsibilities, or consumer protections that cannot legally be excluded.

These disclaimers apply to website and digital-platform use and do not replace ECHON’s obligations under a separately executed entertainment services agreement.

13. Limitation of Liability

To the extent permitted by applicable law, ECONG LLC and its authorized representatives will not be liable for indirect, incidental, special, or consequential damages arising solely from use of, or inability to access, the websites or ECHON Live.

Nothing in this section excludes liability that cannot be excluded under applicable law, including liability for conduct where such an exclusion is prohibited.

The limitations in this section do not replace or modify liability provisions negotiated in a separate written entertainment services agreement.

14. Privacy

Personal information processed through ECHON websites and digital services is addressed in our Privacy Policy.

Users are encouraged to review that policy before submitting personal information.

15. Modifications to These Terms

ECHON may update these Terms as its services, technology, business operations, or legal obligations evolve.

Revised Terms will be made available on the website with an updated effective date.

Where required, additional notice or agreement will be obtained for material changes.

Changes will not retroactively modify signed entertainment services agreements without appropriate contractual authorization.

16. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply.

Disputes concerning these Terms may be brought before a court with appropriate jurisdiction, subject to applicable law.
